Logging near Basin Creek watershed: Judge denies request to reconsider ruling
A district judge has denied a request from environmental groups to reconsider his ruling to allow logging to move forward on 2,600 acres in and around the Basin Creek watershed south of Butte.
U.S. District Judge Donald W. Molloy of Missoula dissolved the case April 10 after he said the Forest Service completed an analysis showing the project would not significantly impact soils.
Tom Woodbury, a Missoula attorney representing Native Ecosystems Council, Wildwest Institute and Alliance for the Wild Rockies, said the Tuesday ruling was expected.
The groups now plan to ask Molloy for a temporary injunction on the timber harvest while they file an appeal with the Ninth Circuit Court of Appeals in San Francisco.
Woodbury argues the project — which includes clearcutting 1,100 acres and building 14 miles of new roads — will impact black-backed woodpeckers, northern goshawks and the American pine martens.
